Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the www.pennyindia.com website (the "Service") operated by Grabbucks Internet Private Limited ("us", "we", "our" or “company”).Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.
Before You use our Program and avail Our services, You must read, understand, accept and agree to abide by all the terms and conditions under this Agreement, including any future amendments or updates .
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.
1)ACCOUNTS
For creating an account with us you must be minimum 16 years old.
When you create an account with us ,we collect certain information like(name ,age ,gender ,contact info ,email id ,bank details and etc.) , you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service according to clause 3.
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.
You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
In certain cases like “missing cashback” you entitle us to share your information with third party affiliated retailers.
By using our service you grant the administrator (“us”) permission to share your info in any emergency situations.
We guarantee you to try our level best for the safeguard of your information.
2)OUR SERVICES
Our priority service is “cashback” and by registering with us as a “member” you are entitled to earn certain cashback amount(in INR) subject to the following conditions:-
i)You visit our site ,redirected by our site and not visit any other(cashback ,price comparison ,coupon and etc.) sites before you make a purchase on the retailer site.
ii)Your purchase from third party retailers is validated and not being cancelled for any reason in future.
iii)The retailer pays us the referral amount.
Whether a transaction shall qualify for cashback shall be at the sole discretion of the retailer or us and the members shall understand and agree the same . We shall not be held responsible if the retailer or the third party sites to which we are tied up fails to report a sale. Further ,due to some technical or other errors if a transaction is not tracked we shall not be held responsible for the same .We will try our level best to track any missing cashback but in certain cases if it couldn’t be traced by us then we shall not be held responsible for the same .
CASHBACK AND PAYMENT:-
The cashback earned by our “members” may take 1-4 days to be reflected in their account initially in pending status and may take 4-16 weeks to get conform depending on the time taken by the retailer as some retailers have cancellation policy of upto 16 weeks .
At present we are paying our members by the following methods:-
-Wire transfer(Bank)*
-Mobile/DTH recharge**
-Flipkart gift voucher
-paytm wallet transfer
*Wire transfer will be done if and only if your account user name and your bank account name both matches. It will be automatically proceeded by us if it is more than ₹50 which is the minimum payout for bank transfer .Sometimes it may take 6-8 days to get credited to your bank account .
**Recharge will be done by us on your registered mobile number within 1-2 days subject to condition that the recharge amount is supported by our recharge partner .
We shall not be held responsible if in certain cases the account number, neft number and etc. provided by you is wrong.
There are various cases in which the cashback will not be payble to the members ,and will be forfeited to us like:
i)You are not logged-in to our site while making a purchase.
ii)Your account has been terminated according to clause 3.
iii)You are associated with any fraudulent activities or any breach of these Conditions.
3)TERMINATION
We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us at care@pennyindia.com .
Your account termination may happen due to the following cases but are not limited to these cases:
i)Found doing any fraudulent activities or any breach to these agreements.
ii)Using our site link in any pornographic sites or any such sites .
iii)If your Account has been associated with any legally questionable activity.
Discontinuation of using our service for 24 months after signing up will lead to termination also and in that case you cashback will be forfeited to us without any prior notice.
In certain circumstances we may terminate our service but prior to that we will inform you regarding this(before 60 days). You should withdraw your balance within this 60 days or else your cashback will be forfeited to us and may not be returned you back.
4)LINKS TO OTHER WEBSITES
Our Service contain links to third-party web sites or services that are not owned or controlled by pennyindia .
Pennyindia has no control over, and assumes no responsibility for, the content, privacy & cookies policies, or practices of any third party web sites or services. You further acknowledge and agree that pennyindia shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services .In any circumstances pennyindia shall not be held responsible for the exchange policy ,defective products purchased from third party sites.
We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.
5)LIMITATION OF LIABILITY
In no event shall pennyindia be liable for any unavailability or inoperability of the links, program web sites, technical malfunction, computer error, corruption or loss of information, or other injury, damage or disruption of any kind beyond reasonable control of pennyindia. In no events shall pennyindia be held responsible for any damaged caused to you or your devices.
7)GOVERNING LAW
These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.
7)CHANGES
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 10 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
